The Inadequate Mayors Act

BILL
TO

Rework the Inadequate Mayors act in order to ensure a clear and precise execution of future Claims of Inadequacy (CoI's).

The Parliament of the Republic of Stratham enacts:

Section 1. Short Title
(1) This Act may be cited as "The Second Inadequate Mayors Act"

Section 2. Commencement
(1) This bill shall be enacted upon its passage and signature

Section 3. Reasoning

The last two Claim of Inadequacies have been riddled with legal questions and unanswered procedure. This bill intends to clarify previous issues with the law.

Section 4. Bill

Subsection a. Filing

A Claim of Inadequacy can be made against a Mayor under one or several of these conditions:
(1)
The city does not complete what is required of it either by law or the DoS within a time the DoS finds reasonable.
(2)
A public petition is created to remove the mayor from their mayoral position and it receives 15 signatures. These signatures must come from residents of the city. The definition of city resident may be changed in future bills, but until that occurs the definition of "resident" for the purposes of this bill is "A player who owns or rents property within the city who has owned such property before the start of the petition or a player who owned or rented property in the city within the last month."

The Mayor has not logged on for more than 2 weeks.

When either of the 3 conditions is met the DoS will begin to organize an official hearing.

Subsection b. Hearing

The Government will take the following steps when organizing a CoI hearing:
(1)
The DoS Minister will present the issue to parliament, they will make the mayor aware of such. In the case of petition, the mayor's inactivity, or failed requirements by law see (4b 3). In the case of failed requirements that have been determined under the DoS minister's discretion or the Mayor requests a discretionary vote on the basis that their inactivity was planned or excusable see (4b 2)

For a CoI filing that has been made with the DoS minister's discretion, the Parliament will vote on the legitimacy of the concern in a simple majority vote. If the vote fails the CoI will be discarded unless the DoS has detailed several met conditions for filing the claim. If the vote passes see (4b 3)

At this point the SoP will follow the "The Vonc In-game Trial Option" Act with the term "VoNC" changed to "CoI" and the term "official" (refering to the accused) changed to "Mayor".

Subsection c. Fate and Voting

The Parliament and Cabinet will now be responsible for voting on the future of the city and then a final vote by parliament to put the plan in motion.
(1) In a chat shared by Cabinet and Parliament the Speaker will hold a poll on all of the following options. As this is a multi-branch decision the PM cannot over-ride the votes of his or her ministers.
- Removal of the City's Official Status (Logistics handled by the DoS, DoC, and DoA)
- Selling or Auctioning the City to a new mayor (Logistics handled by the DoE)
- Repurposing the City for Governmental use
- Relinquishing the city to its Council or Co-Mayor

If there is a tie or other "close vote (determined by the speaker)" The Speaker will remove the least popular option from the list as well as any options that received 0 votes and then run the poll once more. Repeat if need be. If there is a tie between the last 2 options, the DoS minister will make the final call based on their experience with the city.

(2) Now that the new purpose of the city has been determined, Parliament will take one final majority vote to enact the Mayor's removal. If this vote does not pass the CoI will be fully discarded. Any new motion must start from the beginning.

(3) In the case that the city is a private city: As players have the right to their land they must be justly compensated. If the city is being repurposed for government use or being auctioned, the mayor will be compensated at a rate of 3kr per square block of land owned by the city. If the the city's official status is being removed with no future plans from the government, the mayor may choose to waive the 3kr compensation in exchange for the land the city sits on. Players who owned land in the city may ask for their items and buildings to be vaulted. The sub regioning on the land will be removed as well as highway access.

Subsection d. Additional Clauses

(1) If a Claim of Inadequacy is started against a Mayor they may not transfer their position to anyone else until the CoI is dismissed.
(2) The SoP must make an announcement in government announcements following the conclusion of a discretionary or final vote.
