The Executive Order Limitations Act

A
Bill
To

Constitutionally limit the broad powers of Executive Orders.

Section I. Act Name

Section II. Commencement

Section III. Reasoning

Section IV. Constitutional Amendment 1

The Parliament of Stratham Enacts;

Section I. Act Name

  1. This act is The Executive Order Limitations Act.

Section II. Commencement

  1. All provisions of this act are to be effective immediately after passage by the Parliament of Stratham.
  2. In cases of conflicts with previous legislation regarding the topics covered by this Act, this Act is to take precedence.

Section III. Reasoning

  1. Per the request of Prime Minister Tracefais as well as multiple Members of Parliament, this amendment aims to limit the powers of Executive Orders under the constitution. As it stands, Executive Orders can undermine, overrule, and even rescind legislation passed by Parliament, effectively violating the separation of powers outlined within the Constitution.

Section IV. Constitutional Amendment 1

  1. An addition to section two, subsection one, as follows:

    New Text:
(XI) Separation Clause: The Executive Branch may not overstep its constitutional power or infringe upon the powers of other Government Branches via the use of Executive Orders or any other Executive Branch action. Additionally, any and all Executive Orders may not conflict with, supersede, rescind, undermine, or in any other way alter an Act of Parliament.
