Prevent conflict of interest issues when a player is accused of corruption.
The Parliament of Stratham enacts:
Section 1. Short Title
(1) This Act is the Sherlock Accords Execution Repair Act.
Section 2. Commencement
(1) All provisions will take place immediately upon the bill becoming law.
(2) All provisions of this bill will not afford the defendant Ex Post Facto Protection under section 5 of that law.
(3) This bill upon becoming law shall immediately void the "Sherlock Accord Section 1: Execution of the law in court" act.
Section 3. Reasoning
(1) Current Sherlock Accords are insufficient to properly fight minister level corruption. This is because all current cases of corruption must go through the DoJ first and because the case must be done by the government. This creates a massive conflict of interest as the Prime Minister can exert enormous pressure on the cabinet to stifle investigations.
Section 4. Provisions
(1) Any lawyer can bring a sherlock case before the Stratham Court system. They must prove beyond a reasonable doubt that the accused is guilty.
(2) When a government employee or member of parliament is accused of breaking the Sherlock Accords (Deputy Ministers not confirmed by parliament included):
(a) The case shall be posted by any lawyer. A judge can oversee the process under normal court guidelines. The case can be appealed upon the conclusion of the case.
(3) When a government minister is accused of breaking the Sherlock Accords:
(a) The case shall be posted by any lawyer. The Appeals Process Guidelines laid out by the Appeal Process Guidelines Act (Title 3, Chapter 8, Section 6) is used to handle the case. If there are not enough judges to handle the case, then The Judicial Failsafe Act shall be evoked and Parliament will vote a Magistrate in Tempore to assist with the case.
(b) These cases are non-appealable. Double Jeopardy protection applies to the accused once found not guilty.
(4) When a Judge is accused of breaking the Sherlock Accords:
(a) The case shall be posted by any lawyer. The SoP can oversee the process under normal court guidelines. The case can be appealed upon the conclusion of the case. The appeal shall go before Parliament unobstructed by the Speaker of Parliament. All members of Parliament can vote on the appeal to retain and forgive the judge or uphold the conviction.
