1. There is no evidence that this was an attempt to damage the reputation of a corporation, or person(s)

I. Response to the Motion To Dismiss

1. There is no evidence that this was an attempt to damage the reputation of a corporation, or person(s)

- The words used in question was aimed at the plaintiff within the conversation, giving the structure of the sentence and it being said during an election in global in game it give perfect rise to amount of evidence of attacking ones reputation.

2. There is no law regarding where one can speak their opinion on BC, speaking an opinion publicly does not constitute it to be a form of Slander

- When looking to the act slander is defined as “The act of using defamatory statements through means of messages that are untrue to damage the reputation of a corporation, or person(s).” We are entitled to speak our opinions as no law prohibits place to exercise of such however there are laws to protect players from untrue statements made in a public setting. There is having an opinion and there is uttering untrue statements about a person.

3. The evidence does not point to who/what is "moral" this is an assumption

The Cambridge dictionary definition of Moral is as follows: “relating to the standards of good or bad behaviour, fairness, honesty, etc. that each person believes in, rather than to laws” or behaving in ways considered by most people to be correct and honest.” The defendant stated in game: “I can’t stop poem, is legal just not moral.” Which implies that my presence standing within the election is not right when I met all requirements for me to run and am entitled to do so via our constitution.

4. From the Cambridge English Dictionary, the definition of Edgy is "Nervous, not calm"

- We stand with the defence in the definition of the work “Edgy” being nervous, not calm along with another definition within the same dictionary as being nervous or easily upset. The defendant is implying that I am all of these things which he would have know knowledge off. It is a personal judgement about me expressed to a wider audience with the potential to make anyone reading it question me as a person during the election.

To sum this all up; The defendant is allowed to speak of his opinion as long as they comply with our laws and do not target or hurt the reputation of a person which this clearly does. This conversation took place in a public setting in which untrue statements that push an untrue view of me can do immense damage to the plaintiffs reputation. The context of the conversation was relating to the election and as a candidate in that election the words used could have a rapture of effect in my good name. By saying “just not moral” and pushing the word “Edgey” does have an affect and can influence a readers view on a person without any fact or truth to them statements.

CLOSING STATEMENT

v.

Alienbloom20204

Closing Statement

Your honour,

Our case is very simple. The defendant made statements that was not true about my character. To call someone "not moral" and creating an image of a person that is not honest, fair and is of a bad behaviour with previous mentioning how I am "Edgey." In my response to the motion to dismiss I went through how each of these hurts my character. Pushing a image of me especially during an election period in a public space. For this offence the defendant has tick ever box to meet what constitutes slander. The Reputation act is very clear. Where the statements untrue [ yes ] to damage the reputation of a person [ yes ]. Looking to the evidence provided it is a clear line to meet the said requirements. The conversation took place in a public chat during an election period and it could not be more of an attack to leverage said words in order to hurt ones good character.

The Defence MTD did not prove that this doesn't constitute slander and upon having a further chance to submit there opening arguments in an answer to complaint they fail to do so. Not just disrespecting the court times but also showing a complete lack of care for the matter at hand. A distasteful attack and a weak attempt to try and save the defendant from being accountable to there actions and admitting wrong doing and that in fact the plaintiff knows he has slandered me in a manner that is very damaging.

In my Response to the Motion to Dismiss, I summed up the case in a short paragraph and i want to reiterate that today; "The defendant is allowed to speak of his opinion as long as they comply with our laws and do not target or hurt the reputation of a person which this clearly does. This conversation took place in a public setting in which untrue statements that push an untrue view of me can do immense damage to the plaintiffs reputation. The context of the conversation was relating to the election and as a candidate in that election the words used could have a rapture of effect in my good name. By saying “just not moral” and pushing the word “Edgey” does have an affect and can influence a readers view on a person without any fact or truth to them statements."

CLOSING STATEMENTS
Date: 06/15/2024

Poemhunter
Attorney - Poemhunter

v.

Alienbloom20204
Attorney - DoubbleKerius

1. Closing statement
- The evidence put forward does not show any attempt to harm or slander a player, it is speaking one's thoughts of another player and in no context does it show that it is an attempt to effect Elections and/or the view of said player.
- This alone will make people even more afraid to speak in public chats with fear of "My opinion on someone will be considered slander"
- An election is a time to be nervous, stating someone is edgy during an election is not a means of slander, and whether Poem was "nervous" or "Calm" during this is a unknown and unproveable so this cannot be claimed as being untrue or true.
- This case is being argued that this effected the reputation of Poemhunter, As we sit today, Poem is a Parliament Member and Speaker and had one of the highest counted votes this term I believe this alone proves that these words had no effect on the personal reputation or Poemhunter
- The phrase using the word "moral" states, "its legal just not moral", however reading the evidence there seems to be a mixture of conversations going on within the evidence, there is no way to pinpoint where this line of text was targeting, it could very much be Luxaholic, Alien, DoubbleKerius, or Poemhunter that this was stated towards. Meaning this is a unknown statement towards someone, and cannot be argued as slander to only one person
- Lastly, a court case based on Defamation or Slander will be indeed itself, a form of slander within the law due to how the bill is wrote as the following:
(1) With no law in place to define slander and libel, corporations and citizens can have their reputations damaged with false allegations with no repercussions for the liar.
This will be calling someone a "liar" a straight form of Slander to one's reputation,

Lastly, I give the court my Sincer apologies for missing the time stamp on the answer to complaint, I had IRL obligations that impeded me to doing so, I don't find this a joke, nor do I wish to waste anyone's time, This line from the Prosecutor was uncalled for.

In advancing this form to the court, you acknowledge and concur with the rules of court which highlight the importance of honesty at all times. Moreover, you understand the punishments for breaking these rules and/or committing perjury and deception in the court.

Good Afternoon,

After reviewing the arguments and evidence presented, I find the defendant Not Guilty of slander against Poemhunter. My reasoning for this judgement is given below:

As per the Reputation act Section 4 (3) Defamatory is defined as “Remarks that are intended to damage the good reputation of a person(s) or corporate entity.” In the evidence provided by the plaintiff, I see no intention to damage the good reputation of Poemhunter, which would be required for the statement to be viewed as defamatory. While the statement may or may not be untrue (I shall come on to this later), it is being given as an opinion within a conversation between two players, and is not being stated with the clear intention to damage the Plaintiff's reputation.

As per the Reputation act Section 4 (1) Slander is defined as "The act of using defamatory statements through means of messages that are untrue to damage the reputation of a corporation, or person(s).” The Plaintiff has not proven that these statements are in fact untrue. While I would agree that these statements could be hurtful towards them, the Reputation act requires that the statements are untrue in order for them to be considered as Slander, and the Plaintiff has not proven that they are in fact untrue.

The Plaintiff argues that the statements made by the defendant were damaging to his name during the election period, however as mentioned by the defence Poemhunter received one of the highest vote counts in the election and was successful in his campaign for the position of Member of Parliament. The Plaintiff also did not show any evidence that these statements did in fact damage his reputation, for example players deciding not to vote for them as a result of the statements.

In conclusion, while I agree that these statements could be hurtful to the Plaintiff, they failed to show that they match the definition of slander by proving that they were untrue or damaged their reputation.

The court is now adjourned.
