Equal Branches Amendment

TO

Amend the Constitution of the Republic of Stratham to make Judge VoNC votes a 3/4ths majority, un-elected DPM's a 2/3rds majority, and Chief of Staff a 2/3rds majority.

The Parliament of Stratham enacts;

Section 1. Short Title

(1) This may be cited as the Equal Branches Amendment.

Section 2. Commencement

(1) This bill shall be enacted upon its passage and signature.

Section 3. Reasoning

(1)
The position of Judge can currently be VoNCed with a 2/3rds majority. Before the 8th amendment it was 3/4ths like all other positions. Although judges are nominated by the PM they are still in their own branch entirely, and as such, should be as hard to remove as the PM or Members of Parliament.

The position of DPM currently requires a 3/4ths VoNC regardless of circumstances, however, in the case that a DPM resigns before the end of their term, the PM can appoint a DPM in the same fashion as a minister. As this new DPM is not elected they should only require a 2/3rds VoNC. This would apply to any case where a DPM is appointed rather than elected with the PM.

The Chief of Staff is a newly created high level government position that does not currently require a nomination to parliament, however, they do important jobs for the entirety of the government including managing its legal affairs. As this is the case it is only natural that the position has the potential for removal in a 2/3rds VoNC vote by Parliament.

Section 4. Amendment to the Constitution

(1)
Parliament can remove Ministers, the Chief of Staff, an unelected Deputy Prime Minister & The Speaker of Parliament via a vote of no confidence, which requires a supermajority (2/3rds, rounded up) to pass.
(2)
Parliament can remove the Prime Minister, an Elected Deputy Prime Minister, Judges & Members Of Parliament via a (3/4, rounded up) majority vote of no confidence.
